These are the terms and conditions governing your use of the website http://www.Johareez.com/ (herein after referred to as "the Site") constitutes your binding obligations towards Johareez.com Jewellery & Fashion Pvt. Ltd. (hereinafter referred to as Johareez.com) ("User Agreement").

This agreement is effective upon acceptance in registration for new registering users, Johareez.com may amend the User Agreement at any time by posting the amended terms on the Site. All amended terms shall automatically become effective immediately after they are posted on the Site and any subsequent use of the Site shall be governed by such amended terms and conditions. In addition, we will notify you in accordance with your Notification Preferences.

You are advised to regularly check for any amendments or updates to the terms and conditions contained in this User Agreement. If any clause of the User Agreement shall be deemed invalid, void or for any reason unenforceable, such clause shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the User Agreement. You must read, agree with and accept all of the terms and conditions contained in this User Agreement and Johareez.com's Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of Johareez.com.

Use of the Website

By accessing the website, you warrant and represent to the website owner that you are legally entitled to do so and to make use of information made available via the website. Johareez.com reserves the right to terminate your account membership and refuse to provide you with access to the site immediately without liability and without cause.

If you use the Site, you are responsible for maintaining the confidentiality of your account and Password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or Password.

You agree to:

  • Provide true, accurate, current and complete information about yourself as prompted by Johareez.com’s registration form (such information being the "Registration Data")
  • You must not include any of your contact details such as email addresses etc in your username; and
  • Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or Johareez.com have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the User Agreement, Johareez.com has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Site.

Electronic Communications

When you visit the Site or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Disclaimer of Liability

As a merchant, we shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction, on account of the cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

The website owner makes no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the website.

The trademarks, names, logos and service marks (collectively "trademarks") displayed on this website are registered and unregistered trademarks of the website owner. Johareez.com's logos are trademarks of Johareez.com and any of its subsidiaries. All rights reserved. All other trademarks appearing on Johareez.com are the property of their respective owners. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of the website owner.

Prices

Our pricing is based on current precious metal and gemstone prices to give you the best possible value. Because precious metal and gem prices fluctuate, our prices may change. Prices on Johareez.com are subject to change without notice. Please expect to be charged the price for the Johareez merchandise you buy as it is listed on the day of purchase.

Cancellation & Returns

  • You can cancel your product order at no cost any time before we send the Dispatch Confirmation Email for that product.
  • For prepaid orders, the amount will be credited to the payment source (Credit Card/Debit Card/Net Banking).
  • Once the product is returned under our 30-Day Money Back return policy, the refund will be credited your bank account or the original source of payment method used upon checkout.
  • For cash on delivery orders, the refund will be processed to your bank account.
  • Upon cancellation/return of orders placed using gift cards, the gift card amount will be refunded back to the gift card.

Monitoring

Johareez.com shall have the right, but not the obligation, to monitor the content of Johareez.com, to determine compliance with this Agreement and any operating rules established by Johareez.com and to satisfy any law, regulation or authorized government request. Johareez.com shall have the right in its sole discretion to edit, refuse to post or remove any material posted on Johareez.com.

Applicable Laws

The use of this website is governed by the laws of the state of Rajasthan, India, in all respects, regardless of the laws that might be applicable under principles of conflicts of law. The parties agree that all controversies arising under this agreement will be subject to the exclusive jurisdiction of the courts located in Rajasthan, India, and agree that the venue is proper in those courts.

As per the current guidelines mandated by the Government of India, customers must provide their Permanent Account Number (PAN) for all purchases above INR 2 lakh.

Payment Gateway Transactions & Obligations

Payments for items on the Site can be made through the online payment facility provided by CCAvenue. At present, CCAvenue supports the following payment options for you to choose from:

  • Credit Card Payments: Visa, Master Card, RuPay
  • Debit Card Payments: Visa, Master Card, RuPay
  • Net Banking
  • PayTM Wallet
  • Other Wallets: MobiKwik, OlaMoney, JioMoney, FreeCharge, Aircel Money, Airtel, ICICI Pockets & Itz Itz Cash Card.
  • UPI: BHIM, PhonePe, Google Pay, PayTM, WhatsApp & Other UPI options.
    By providing an online payment facility on the Site through CCAvenue, Johareez.com is merely facilitating the making of online payments by buyers as per their contractual obligations to Johareez.com on the Site.
  • The details of the offer shown are based on information provided by the Merchant. CCAvenue makes no warranties that the information is correct. Please confirm availability and validity of the Offer directly with the Merchant.
  • The Merchant is the sole provider of all goods and/or services under this offer. The credit card holder understands, acknowledges, and agrees that the procurement of any goods and/or services under this Offer shall constitute a contract solely between the merchant and the cardholder. CCAvenue is not, nor will become, a party to it.
  • By utilizing or attempting to utilize any of the goods and services under this Offer, the cardholder understands, acknowledges, and agrees that:
    • Any claim, complaint, or dispute arising out of or in relation to the procurement or attempted procurement by the cardholder of any goods and/or services under this offer (each a "Claim") shall be settled by the cardholder directly with the Merchant. The cardholder shall not make any Claim against CCAvenue.
    • Without prejudice to the foregoing, and to the fullest extent permitted by law, CCAvenue shall not be liable to any person for any loss, damage, expenses, or claim (whether direct or indirect) in relation to any personal injury, death, false representation, damage, or omission arising from or in connection with the usage or attempted usage of the Offer or goods and/or services provided under the Offer.

All purchases on the Site are a firm commitment to purchase. If you are the purchaser for any item, you are obligated to complete the transaction with the Site. An action to purchase by purchasing an item, you agree to be bound by the conditions of sale included in the item's description (or linked to from the description) so long as those conditions of sale are not in violation of the User Agreement or unlawful.

By entering into this User Agreement, the customer agrees to complete the transaction. In which case, the customer will be held accountable if they do not fulfil this obligation. If payment is not made, account privileges may be subject to suspension and Johareez.com maintains the right to cancel outgoing invoices at their own discretion. Reasons for such actions include but are not limited to multiple non-pays, unresolved chargeback issues, an undeliverable address, or the refusal to pay custom fees (if applicable). Johareez.com reserves the right to demand payment if customer has unpaid items in their account. To avoid this situation please pay on time.

Limitation of Liability

In no event shall Johareez.com be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Site, its services or this agreement (however arising, including negligence). Johareez.com's liability in any circumstance is limited to the amount of fees, if any, paid by you to Johareez.com. Johareez.com, its associates and technology partners make no representations or Warranties about the accuracy, reliability, completeness, correctness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Site or that the operation of the Site will be error free and/or uninterrupted. Consequently, Johareez.com assumes no liability whatsoever for any monetary or other damage suffered by you on account of:

  • The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Site; and/or
  • Any interruption or errors in the operation of the Site. You expressly understand and agree that Johareez.com shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Johareez.com has been advised of the possibility of such damages).

Privacy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy. We view protection of users' privacy as a very important community principle. We understand clearly that you and your information is one of our most important assets. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices.

Indemnity

You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of the User Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

Relationship and Notice

None of the provisions of the User Agreement shall be deemed to constitute a partnership or agency between you and Johareez.com and you shall have no authority to bind Johareez.com in any manner whatsoever. Except as explicitly stated otherwise, any notices shall be given by postal mail to Johareez.com Attn: Legal Department at F1, Jeevan Vihar Complex, New Colony, M.I. Road, Jaipur:- 302001, Rajasthan, India (in the case of Johareez.com) or to the email address you provide to us during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you notice by certified mail, shipping prepaid and return receipt requested, to the address provided to us during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.

Contests

  • Winners of contests and giveaways will be selected at the company's discretion.
  • Prizes, gifts, and giveaways are non-returnable and non-exchangeable.
  • Any additional facilities provided by the company to winners and selectees of any contest are at the company's discretion.
  • Johareez.com reserves the right to change the terms and conditions of contests and giveaways without prior notice.
  • All disputes will be resolved at support@johareez.com

Other Terms & Conditions

Johareez.com may also terminate this User Agreement if Johareez.com is of the view that risks involved in continuing with the User Agreement outweigh the benefits or in the event of Johareez.com receiving any customer complaints about any registered member. The Site is not available to persons whose membership has been suspended or terminated by Johareez.com. Johareez.com may change (add to, delete, or amend) these terms from time to time.
